  1. About this policy
    1. Hi-Quality Concrete ACT Pty Ltd (ACN 634 156 086) (“the Company”) takes your right to privacy seriously and understands the importance of upholding stringent standards in collecting, managing and disclosing your information.
    2. This document forms the Company’s Privacy Policy and outlines the Company’s commitment to upholding your privacy by complying with the Australian Privacy Principles (“the APPs”) contained in the Privacy Act 1998 (Cth) (“the Privacy Act”).
    3. You may access a copy of the APPs from the website of The Office of the Australian Information Commissioner at www.aoic.gov.au.
  2. Types of information collected
    1. The Company collects a wide variety of information, which may include your personal information depending on the nature of your interaction.
    2. ‘Personal information’ is defined by the Privacy Act as information that can be used to identify an individual. The Company collects various types of personal information, including:
      1. first and/or last names;
      2. mailing and/or street address;
      3. email address;
      4. telephone and facsimile numbers;
      5. age and/or date of birth;
      6. profession, occupation or job title;
      7. banking details, including BSB, account number and branch;
      8. tax file number;
      9. superannuation details;
      10. drivers licence details;
      11. emergency contact details;
      12. trade reference details;
      13. information (excluding sensitive information) you directly provide to the Company from time to time when engaging with the Company’s online presence, requesting quotes, completing surveys, applications for commercial credit or corresponding with the Company’s representatives; and
      14. additional information (excluding sensitive information) that you indirectly provide to the Company through engagement with the Company’s online presence, its representatives or otherwise.
    3. The Company collects personal information in a variety of ways, including:
      1. email correspondence;
      2. written correspondence;
      3. completion of various documents, such as a written agreement, application for commercial credit or similar document with the Company;
      4. conversations between you and a Company representative;
      5. through your engagement with the Company’s online presence, for example by using the Company website at www.hqconcrete.com.au (“the Website”) or interacting with any of the Company’s social media; and
      6. if applicable/necessary, from third parties, including but not limited to law enforcement agencies, financial institutions, credit rating agencies and government entities.
  3. How personal information is collected
    1. Sources of information
      • The Company collects information from a variety of sources including, but not limited to customers, employees, contractors, suppliers, sub-contractors, users of the Company’s online services and government agencies.
    2. Methods of information collection
      1. The Company collects information from you in a variety of ways including, but not limited to:
        1. hard copy/paper-based means;
        2. electronic means, be it via email or social media correspondence, online submissions or otherwise;
        3. public databases;
        4. in person meetings;
        5. telephone communication;
        6. facsimile communication; and
        7. use of the Website and the Company’s social media sites.
      2. Where reasonable and practicable to do so, the Company will collect your personal information only from you. However, in some circumstances the Company may be provided with information by third parties or need to obtain information from third parties. In these cases, the Company will take reasonable steps to ensure that you are made aware of the information provided to it by a third party.
      3. If the Company seeks to collect another individual’s personal and/or sensitive information from you, you must not provide such information without first receiving consent from that individual and directing them to this Privacy Policy.
      4. When you browse the Website, your personal and/or sensitive information will not be automatically collected by the Company. However, if you visit the Website, information will automatically be collected from you via the following methods:
        1. Actively submitted user data
          1. If you make an online submission using the ‘Contact us’ or ‘Quote Request’ pages on the Website, you will be actively providing the Company with whatever information you choose to include in the submission, which may include personal information such as your name and email address. This information may be automatically recorded by the Company’s servers.
          2. The Company’s servers may record any other details included in an online submission you make. If you send the Company an email directly, the Company’s servers may record your email address and any other information in that email correspondence. Your email address will not be added to a Company mailing list unless you have chosen this as an option or asked to be added.
        2. Clickstream data
          1. On each occasion you visit the Website, the Company records the following information which is taken from its web server logs:
            1. your IP address;
            2. the date and time of your visit;
            3. the pages on the Website accessed and documents downloaded (if any);
            4. the website(s) you visited immediately before the Website; and
            5. the type of web browser and operating system you are using,
              together, "Clickstream Data"
        3. Squarespace
          1. The Website is hosted by Squarespace, which collects the following information from you on each occasion you visit the Website:
            1. Clickstream Data;
            2. data from online submissions you make to the Website; and
            3. the website(s) you view while visiting the Website.
          2. The Company shares the above information with Squarespace so that Squarespace can run the Website, protect and improve its platform and services and track and respond to your submissions. Any information collected by Squarespace is analysed in a de-personalised form. Squarespace also shares this information with Zapier Incorporated (“Zapier”) for data porting purposes.
          3. By using the Website, you consent to Squarespace collecting and processing the above information for these purposes and to Squarespace sharing this information with Zapier. You may access further information about Squarespace’s and Zapier’s respective privacy policies at www.squarespace.com/privacy and www.zapier.com/privacy.
        4. Google Analytics and associated Google products
          1. As the Company uses products provided by Google LLC (“Google”) (such as Google Analytics) to increase the Website’s performance, information generated by “cookies” about your use of the Website is collected by Google on each occasion you visit the Website. This information will be collected and stored by Google on overseas servers in the United States of America and used to assess usage of the Website and compile reports for the Company on the Website’s activity, amongst other things.
          2. By using the Website, you consent to Google collecting and processing data generated by “cookies” when you visit the Website and using this for the purposes stated above. You may access further information about Google’s privacy policy at www.policies.google.com/privacy.
  4. Why personal information is collected
    1. The Company collects, holds, uses and discloses personal information you may provide for:
      1. its primary purposes of performing its business activities, providing the highest quality service to customers and complying with its various legal obligations;
      2. a range of general purposes including, but not limited to:
        1. communicating with and providing information to you and any other relevant third parties regarding sales, applications, contracts, performance of works and the like;
        2. maintaining information relating to intentions, financial processes, eligibility for credit applications and provision of goods and/or services;
        3. providing you and any other relevant third parties with information relevant to the Company’s engagement to provide goods and/or services;
        4. recording, requesting and making payments to you, consultants, contractors and any other relevant third party;
        5. maintaining and administering your account with the Company (if any) and processing payments you have authorised;
        6. improving the Website or the goods and services provided by the Company;
        7. monitoring who is accessing the Website and engaging the Company’s services;
        8. providing information in response to complaints or enquiries;
        9. undertaking research and preparing surveys, reports and quotes;
        10. responding to claims against the Company;
        11. performing administrative and operational tasks, including quality assurance and training purposes; and
        12. any other purposes identified at the time the information is collected from you.
    2. By providing the Company with personal information, you are acknowledging and consenting to the Company collecting, using and disclosing your personal information for the purposes listed above as well as separate but related purposes.
  5. Disclosure of personal information
    1. By enabling the Company to collect information from you, you are acknowledging and consenting to the Company disclosing your personal and/or sensitive information it has collected to:
      1. the Company’s employees, subsidiaries, officers, agents and/or related bodies corporate;
      2. any third parties (including contractors, subcontractors and suppliers) who the Company engages to perform the work/provide the goods and services you have engaged the Company for;
      3. government departments/agencies;
      4. past, present or prospective credit providers of yours;
      5. third parties who provide the Company with services, such as legal advisors, accountants, insurers, IT service providers, mail out service providers and the like;
      6. third parties who assess eligibility for credit/credit scores in the event you are in breach of an agreement relating to credit provided by the Company;
      7. additional third parties where you consent to the use or disclosure; and
      8. any other entity that the Company is required or authorised by law to disclose the information to.
    2. The Company may disclose your personal or sensitive information to other entities, third-party suppliers, contractors or service providers who are located overseas for the same purposes listed above. If the Company needs to disclose your personal information to an overseas entity, it will take reasonable steps to ensure that the overseas entity also complies with the APPs.
    3. Unless an exception in the Privacy Act arises, the Company will only use or disclose your personal information in the following circumstances:
      1. in relation to personal information, the purpose it was collected for or another purpose related to the purpose it was collected for;
      2. if you provide consent;
      3. if you would reasonably expect the Company to use or disclose your personal information in accordance with the purposes listed above;
      4. if disclosure would lessen or prevent a threat to public safety or the life, health or safety of an individual; or
      5. if the Company is authorised or required to do so by law or it is reasonably necessary to assist a law enforcement related activity.
    4. The Company is not responsible for the policies of any authorised third parties whose online presence is linked to the Website.
  6. Where personal information is stored
    1. The Company takes reasonable steps to protect your personal and sensitive information from misuse, loss and unauthorised access/disclosure. All personal and sensitive information collected by the Company is stored securely in either an electronic or hard copy format depending on how that information was provided to the Company. Access to this information is restricted to specific individuals within the Company authorised to handle personal and sensitive information. The Company will not store your personal and sensitive information for any longer than is necessary for the purposes listed above. When your personal and sensitive information is no longer required for these purposes, it will be destroyed and removed from the Company’s database.
    2. If the Company stores information in ‘the cloud’ or with overseas information storage providers, that information may be located on servers/databases situated outside of Australia. In these cases, the Company will take reasonable steps to ensure that the overseas entity also complies with the APPs.
    3. Despite these steps being taken, the Company cannot guarantee the security of your information and any information you provide to the Company is done so at your own risk.
  7. Privacy breach
    1. If the Company identifies an actual or potential breach of your personal information, an internal assessment will be undertaken over the subsequent 30 business days to assess the nature and scale of the breach before notifying you of the breach, if necessary. The Company will otherwise comply with all privacy breach requirements at law, including notifying the Office of the Australian Information Commissioner, if applicable.
  8. Accessing personal information
    1. At any time, you are able to request access to any of your personal information the Company may hold by making a written request via email or letter. The Company will then provide you with access to the information unless:
      1. it is prohibited by law;
      2. giving access would have an unreasonable impact on other individual’s privacy; or
      3. the information relates to existing or anticipated legal proceedings and would not be discoverable in those proceedings.iii. the information relates to existing or anticipated legal proceedings and would not be discoverable in those proceedings.
    2. If access to the requested information is refused, the Company will provide you with a written explanation for the refusal.
    3. The Company may request that you provide certified forms of your identification along with your email/letter to prove it is your information that you are requesting. If someone is requesting your personal information on your behalf, the Company may also require them to provide a consent form signed by you which authorises them to receive your personal and/or sensitive information.
    4. While the Company will not charge any fee for your request, it may charge an administrative fee for compiling and providing a copy of your information.
    5. You are also entitled to request this Privacy Policy be provided to you in an alternative form, such as in hard copy.
  9. Pseudonyms and anonymity
    1. Should you wish, you will be provided with the option to use a pseudonym or remain anonymous while interacting with the Company, so long as:
      1. the Company is not required or authorised by law or a court or tribunal order to deal with you in an identifiable way; or
      2. it is practicable for the Company to deal with you in a de-identified capacity.
    2. The Company may ask you to identify yourself in instances where it is necessary to enable the Company to perform a specific task or role that you are engaging the Company to do, or is otherwise related to this engagement.
  10. Policy updates
    1. The Company reserves the right to update this Privacy Policy from time to time, with any updated versions being published on the Website. The Company will take reasonable steps to notify you of any changes to this Privacy Policy but encourage you to review the Website to keep yourself appraised of any changes.
    2. Unless otherwise provided in this Privacy Policy, you will be bound by any changes immediately upon publication of the updated Privacy Policy.
